What is Arbitration?

Unlike Mediation, where a Mediator listens to each side and works to reach an agreement among the parties, Arbitration is similar to a trial, but in a much less formal setting.  Each side presents their evidence and arguments to be considered by one or more arbitrators who then render a decision.

Depending on the dispute, Arbitration can be binding on the parties, with little or no right to appeal a decision.  Non-binding Arbitration follows the same procedure, but allows either party to appeal a decision with which they disagree.  Both can be effective means for resolving a dispute.

Many parties prefer to Arbitrate their dispute by videoconference, while others prefer to resolve their dispute in person.  BAM has the resources to accommodate either preference.

Unlike Arbitration, where one or more Arbitrators adjudicate the evidence and issue a decision to the parties, Mediation is a voluntary, non-binding process in which a Mediator listens to each side and works to bring the parties to agreement on a resolution of their dispute.

Mediation is a voluntary, reconciliatory process designed to bring parties together for an agreed resolution of their dispute.  The Mediator listens to each side and serves as an ambassador to negotiate a resolution that is acceptable to both parties.
