Unlike Mediation, where a Mediator listens to each side and works to reach an agreement among the parties, Arbitration is similar to a trial, but in a much less formal setting. Each side presents their evidence and arguments to be considered by one or more arbitrators who then render a decision.
Depending on the dispute, Arbitration can be binding on the parties, with little or no right to appeal a decision. Non-binding Arbitration follows the same procedure, but allows either party to appeal a decision with which they disagree. Both can be effective means for resolving a dispute.
Many parties prefer to Arbitrate their dispute by videoconference, while others prefer to resolve their dispute in person. BAM has the resources to accommodate either preference.
